Mark A.R. Kleiman, the eminent scholar of drug policy who died in 2019, often argued that vices like cigarettes, alcohol and marijuana needed what he called ‘grudging toleration’: legal permission combined with stiff restrictions designed to mitigate the social and individual harms of use. Such an approach also requires social intolerance—a collective sense that a behavior is permitted but just barely.
